Okla County DA drops murder charge against 15-yr-old

OKLAHOMA CITY — A charge of first-degree murder has been dropped against a 15-year-old in the death of a 17-year-old at an August football game.

Oklahoma County District Attorney Vicki Zemp Behenna dismissed a First Degree Murder charge against Dayvion Hamilton, 15, in the shooting death of Cordae Carter, 17.

Hamilton had been charged with murder in September after an investigation of a shooting at the Choctaw versus Del City High School football game on August 25, 2023.

The charges filed against Hamilton were based on a “witness identifying him as the suspect to police. Subsequent to the charges being filed, the witness recanted their identification of Hamilton. As such, the charges against Hamilton were dismissed without prejudice, meaning charges can be refiled,” according to the press release.

The charge was dropped “without prejudice” meaning that charges can be refiled.

The DA’s office requested assistance from the Oklahoma State Bureau of Investigation (OSBI). Their investigation into Carter’s death and the shooting of a female student remain “open and ongoing” according to spokesperson Brook Arbeitman.

“To Cordae’s family, I promise we are not giving up on identifying and prosecuting the person responsible for his death,” said DA Behenna. “The OSBI is following investigative leads and processing evidence. Based on their investigation, charges can be refiled in the future since there is no statute of limitations for murder.”

The DA’s office is asking for anyone who was at that football game and has any information or video or photos of the fight that led to the shootings to please contact the OSBI at 1-800-522-8017. Callers can remain anonymous.
