Is the complaint process different during an election year?

The complaint process does change during an election year. As we begin the 2024 election cycle, please know that the Ethics Commission cannot accept external complaints that allege a candidate, or a candidate committee violated the Ethics Rules. This complaint “blackout period” begins the first day that the State Election Board accepts Declarations of Candidacy, and it ends on the last day of the General Election during the same year. This provision is intended to prevent the complaint process from being used for political purposes during a campaign.

Notwithstanding, the Commission may always engage in internal investigations, regardless of the complaint “blackout period”. See Rule 6.4.
