OKLAHOMA CITY – A shooting in southwest Oklahoma City earlier this month has been upgraded to a homicide after the victim died of his injuries days later, and police say the suspect arrested will be charged with murder.
Just after 9:00pm on Friday, May 1st, OKC police were alerted to a shooting at a residential house near SW 44th St. and S Pennsylvania Ave.
When police arrived, they found 42-year-old Justin King shot, but still alive.
King was rushed to a nearby hospital to be treated.

According to police, investigators determined that King had been shot by 59-year-old Timothy Smith, the owner of the house, following what police claim was an argument over King being on Smith’s property.
Smith was arrested the following day and booked on a count of assault with a deadly weapon.
A week later, on Friday, May 8th, King succumbed to his injuries and died in the hospital, elevating to the shooting to a homicide, Oklahoma City’s 26th of 2026.
Police say the charges against Smith will be upgraded in accordance with homicide.
